Terms and conditions of sale
1. The seller
The works presented on capucinefrecciani.com are sold by Capucine Charria, sole trader (entrepreneuse individuelle, EI), working under the artist name Capucine Frecciani.
- SIRET: 105 229 165 00011
- Address: 5 avenue du Bassin, Pyla, 33115 La Teste-de-Buch, France
- Email: contact@capucinefrecciani.com
- Phone: +33 6 35 97 23 53
These terms apply to any order placed on the website by a private individual. You accept them by ticking the box provided before paying. The version in force is the one displayed on the website on the day of your order.
2. The works
Each work is a fine art photographic print on paper, made by a professional laboratory, in a limited and numbered edition.
- The edition. The format, the paper and the total number of copies of each image, artist's proofs included, are stated on its page. This number will never be increased.
- The number. Copies are numbered in the order in which they are sold. The page states the number of the copy on sale, for example 7 of 25.
- The certificate. Each print comes with a certificate of authenticity bearing my signature, stating the title, the format, the copy number and the date. The back of the print carries a duplicate of the certificate.
- No frame. The print is sold on its own, without a frame or mounting. Framing advice is given on the website.
- Colours. The images on the website are displayed as faithfully as possible, but every screen renders colours differently. A slight difference between the image on screen and the print is not a defect.
Prints on acrylic glass, artist's proofs and framed prints are not sold online. They are available on request at contact@capucinefrecciani.com.
3. Prices
Prices are shown in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code. Delivery is included in the price for all the countries listed in article 5: nothing is added at checkout.
The price of each image rises in steps as copies are sold: it goes up by about 15% every five copies sold, all formats combined, and never goes down. The price that applies is the one displayed when you order. The price you pay is always honoured, even if two orders arrive at the same moment.
4. Ordering and payment
- On the work's page, you choose the format and click “Acquire”.
- You are taken to the secure payment page of my payment provider. There you enter your email address, your delivery address and your card details, then tick the box accepting these terms.
- The sale is concluded as soon as the payment is accepted.
- You receive an email confirming your order, with these terms and the withdrawal form.
Payment is made by card. I never have access to your bank details.
A sold copy is removed from sale at once, and the next one is offered at its own price. If, exceptionally, I could not fulfil an order, I would refund you in full within fourteen days.
5. Delivery
Delivery countries. Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Ireland, Italy, Lithuania, Luxembourg, Netherlands, Norway, Poland, Portugal (excluding the islands), Romania, Slovakia, Slovenia, Spain (excluding the islands), Sweden, Switzerland, United Kingdom. For any other country, write to me before ordering.
Delivery time. Your print is shipped within ten working days of your order. Delivery then takes, as a guide, one to two working days in France and two to four working days elsewhere in Europe.
Packaging. Every print travels flat, protected between two rigid boards.
Costs and customs. Delivery is included in the price. For the United Kingdom, Switzerland and Norway, customs duties and import taxes may be charged to you on delivery: they remain your responsibility.
On delivery. The print remains my responsibility until you receive it. Check your parcel as soon as it arrives. If it is damaged, note it with the courier if you can, and write to me with photos, ideally within 48 hours: I will replace the print or refund you.
6. Right of withdrawal
You have fourteen days to change your mind, without giving any reason. This period starts on the day after you receive the print.
How to withdraw. Let me know before the period ends, by email at contact@capucinefrecciani.com or using the form below. One clear sentence is enough.
Returning the print. Send the print back within fourteen days of your message, in its original packaging and with its certificate of authenticity, to the address given in article 1 or to the one I give you. Return costs are your responsibility. The returned copy keeps its number and goes back on sale.
The refund. I refund the full price paid within fourteen days of your message, using the same means of payment. I may wait until I have received the print, or proof that you have sent it back, before refunding you.
Condition of the print. You may unpack it and examine it. However, if it is damaged, framed, glued or written on, its loss of value may be deducted from the refund.
The exception. The right of withdrawal does not apply to a work made to your specifications, for example in dimensions you asked for or with a dedication. In that case, I tell you so in writing before you order.

Complete and return this form only if you wish to withdraw from the contract.

7. Legal guarantees
Each print is covered by the legal guarantee of conformity and the guarantee against hidden defects. To claim under them, write to me at contact@capucinefrecciani.com with photos of the defect. The text below is a translation of the wording that French law requires me to reproduce.
The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish that the lack of conformity exists, not when it appeared.
Where the contract of sale provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish that the lack of conformity affecting the digital content or digital service exists, not when it appeared.
The legal guarantee of conformity requires the trader, where applicable, to provide all the updates needed to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.
If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date the goods are replaced.
The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if: 1° the trader refuses to repair or replace the goods; 2° the repair or replacement takes place after more than thirty days; 3° the repair or replacement causes major inconvenience to the consumer, in particular when the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods; 4° the goods remain non-conforming despite the trader's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to terminate the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case, the consumer does not have to request repair or replacement first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the goods are delivered back in working order.
The rights set out above result from articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund if the goods are returned.
8. Copyright
Buying a print makes you its owner, but does not transfer any copyright. Any reproduction, publication or commercial use of the image requires my written consent.
9. Mediation and disputes
If there is any difficulty, write to me first at contact@capucinefrecciani.com: I always look for a solution.
If we cannot reach an agreement, you can refer the matter free of charge to the consumer mediator I belong to: CM2C, 49 rue de Ponthieu, 75008 Paris, France, with an online request at cm2c.net/declarer-un-litige.php. You must have written to me first.
These terms are governed by French law. If you live in another country, you keep the protections that the law of your country gives you.
10. Personal data
How your data is used is described in the privacy policy of this website.
